Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Service Description

FurniMesh provides an AI-powered service that converts 2D images into 3D models. The Service includes:

• Conversion of 2D images into 3D models using artificial intelligence
• Storage of both original uploaded images and generated 3D models
• Access to generated models through our platform
• Options for public and private model storage

We strive to provide high-quality 3D model conversions, however, the accuracy and quality of the output may vary depending on the input image quality and complexity. We make no guarantees regarding the exact accuracy or suitability of the generated models for any specific purpose.

2. Credit System

The Service operates on a hybrid subscription-credit model:

2.1. Credit Usage

• Each model generation requires a specific number of credits
• Credit requirements may vary based on model complexity and processing requirements
• We reserve the right to modify the number of credits required for any service at any time
• Changes in credit requirements may occur due to increased costs of cloud services, GPU providers, or other operational expenses

2.2. Subscription and Credits

• A paid subscription is required to download or share generated materials
• Each subscription plan includes a monthly credit allocation
• Credits are automatically refilled monthly based on your subscription plan
• Credits will not accumulate above your plan's monthly allocation threshold
• Unused credits do not roll over if you're at or above your plan's threshold

3. User Rights and Content

3.1. Content Ownership

• You retain ownership of your original uploaded images
• By uploading images, you grant us a license to use them for providing the Service
• We can use publicly shared models for our purposes, including marketing and service improvement
• Private models (requiring extra credits) will remain private and will not be shared or used by us

3.2. Storage and Retention

• We store both original images and generated 3D models
• Content is retained for a period of 5 years
• We reserve the right to modify the retention period at any time
• You may request deletion of your content at any time through our platform

4. Account Terms

4.1. Account Requirements

• You must be 18 years or older to use the Service
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access to your account

4.2. Subscription Terms

• Subscription fees are billed according to your chosen plan
• All fees are non-refundable unless required by law
• We reserve the right to modify subscription prices with notice
• Cancellation of subscription may result in limited access to services

5. Prohibited Uses

You may not:

• Use the Service for any illegal purposes
• Upload content that infringes on intellectual property rights
• Attempt to reverse engineer the Service
• Share account credentials with unauthorized users
• Abuse the Service in ways that may overload or disrupt our systems

6. Service Quality and Liability

• We do not guarantee the quality, accuracy, or specific outcome of any 3D model generation
• Model quality may vary based on input image quality, complexity, and other factors
• We do not take responsibility for the commercial viability or fitness for any particular purpose of generated models
• The Service is provided "as is" without warranties of any kind

6.2. Service Availability

• While we strive to maintain high service availability, we do not guarantee uninterrupted access
• We will make reasonable efforts to restore service during downtime but accept no liability for any service interruptions
• We are not responsible for any losses, damages, or inconvenience caused by service downtime
• Scheduled maintenance will be announced when possible, but emergency maintenance may occur without notice

6.3. Limitation of Liability

To the maximum extent permitted by law, FurniMesh shall not be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, business opportunities, or anticipated savings
• Any expenses or material damages due to service provision errors or downtime
• Costs associated with failed or incomplete model generations
• Loss of data or business interruption
• Any damages resulting from: a) Your use or inability to use the Service b) Service interruptions or downtime c) Model generation errors or quality issues d) Unauthorized access to your account or data e) Changes to the Service or pricing f) Technical issues or failures

6.4. Indemnification

You agree to defend, indemnify, and hold harmless FurniMesh from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the Service.

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
